Pro Moldova requests CC to pronounce on state of emergency

The parliamentary group Pro Moldova asked the Constitutional Court (CC) to urgently examine the May 4 requisition concerning the official interpretation of constitutional articles that regulate the states of emergency, siege or war and force majeure. Accosting to the MPs, owing to the unclear formula stipulated by the law, the state of emergency is not regarded as force majeure and this leads to random interpretations, causing damage to the people and making the business environment vulnerable, IPN reports.

In a press release, the parliamentary group Pro Moldova says that it requested to interpret the Constitution and to class the state of emergency as justifying impediment, force majeure for the business community and private individuals.

“The coronavirus pandemic produced negative effects on the people’s health and struck important areas of the country’s economy. The profoundness and size of the crisis generated by the pandemic necessitate an immediate response from the public authorities,” says the requisition to the CC.

On May 4 this year, Pro Moldova filed a complaint to the CC as a result of multiple complaints that came from businesspeople and citizens, who said they encounter major difficulties in fulfilling the contractual obligations in the period.

Earlier, as the group said, a set of measures in support of the business community and employees during the state of emergency was registered, but the Government didn’t debate it.
