Previous method of appointing prosecutor general to be restored

The MPs approved amendments to the law on the prosecution services in two readings after the Constitutional Court declared a number of provisions unconstitutional. The parliamentary opposition said that besides the aspects declared unconstitutional, there are a number of amendments and it is not clear the hurry in which the bill is forwarded as this reached the legislature one day before the plenary sitting, IPN reports.

Secretary of state at the Ministry of Justice Radu Foltea said the bill allows for the restoration of the previous procedure for appointing the prosecutor general – by a transparent contest organized exclusively by the Superior Council of Prosecutors. If the post of prosecutor general falls vacant, the Council will exercise the prerogative of choosing an acting prosecutor general.

The transfer of the prosecutor to a post of the same level or a lower level, except for the posts of chief prosecutor and deputy chief prosecutor, will be made by order of the prosecutor general at the suggestion of the Superior Council of Prosecutors. The amendment allows persons who served as prosecutors for at least ten years to apply for the post of prosecutor general without taking an exam before the graduation commission of the National Institute of Justice.
