Two weeks ahoy, in the context of the removal of Domnica Manole, the Party of Action and Solidarity said a document that had its effect cannot be revoked. Now President Maia Sandu does the same – annuls a decree that had its effect, the president of the Legal Resources Center from Moldova Vladislav Gribincea stated, referring to the revocation of the decree to name Vladislav Clima as president of the Chisinau Appeals Court, IPN reports.
“I harshly criticized the appointment of Mister Clima as president of the Chisinau Appeals Court as it was neither ethical nor honest. But the appointment can no longer be revoked as it already occurred or there will be nothing left of the independence of judges. Without their independence, we cannot have the rule of law for which the PAS pleads! Justice cannot be done through injustice!” Vladislav Gribincea posted on Facebook.
“Missis President, I don’t know who advised you to issue this decree. I urge you to seriously question the professionalism or good faith of this person. If this was done intentionally, better sabotage cannot exist.”
In her announcement concerning the revocation of the September 2, 2020 decree by which President Igor Dodon appointed Vladislav Clima as the president of the Chisinau Appeals Court for a four-year term, President Maia Sandu says the Superior Council of Magistracy violated the legal procedures and allowed an inadmissible conflict of interests when it proposed naming Clima to this post. According to President Sandu, the Council should review this decision and should make sure that its next decisions on appointment fully meet the legal provisions, while the candidates meet the integrity criteria.
The appointment of Vladislav Clima as president of the Chisinau Appeals Court on September 2, 2020 was harshly criticized by the opposition and by civil society, which said that judge Clima is one of those who upheld the decision to invalidate the mayoral elections held in Chisinau in 2018.
