Jurists of the National Liberal Party (PNL) suggest creating a parliamentary commission for modifying a number of pieces of legislation that were changed by the former Communist government with the aim of undermining the legal system. According to the leader of the PNL Vitalia Pavlicenco, the legal system in Moldova is a victim of the Communist regime. A parliamentary commission should be created immediately so as to amend the most important articles of the national legislation and make the legal system independent. The number of cases sent to the Supreme Court of Justice from the courts of appeal is very high. But the Supreme Court of Justice can only overturn the illegal decisions and adopt opposite decisions. Vitalia Pavlicenco said a part of the judges who know that they cannot be held accountable for the mistakes committed intentionally or out of ignorance behave impudently during hearings. Unfortunately, the civil society remains indifferent to the adoption of illegal decisions by judges, she said. According to lawyer Iulia Deleu, article 1 405 of the Civil Code, which defines the responsibility of the state for the actions taken by the prosecutor's offices and courts of law, should be modified or abrogated. This article, which was modified by the Communist administration, runs counter to article 16 of the Constitution, which describes the principle of equality before the law. Jurist Filip Druta said article 18 of the Civil Code should be modified so that it allows the sides to film and record the trial, as this will ensure transparency. Druta considers that amendments should be introduced to the law on the status of judge so that the Government is obliged to file appeals against the judges who cause damage to the state. “In this case, it will be the court to decide whether to take legal action against the judges who break the law, not the executive as at present.” the jurist said. All the participants in the conference said there are many honest judges who committed mistakes influenced by the fear that dominated the society during the Communist government. The jurists of the PNL made public a statement that includes proposals for reforming the legal system.
