Plaintiffs will be exempted from state tax for examining appeals against appeals court decisions

The plaintiffs, both legal entities and individuals, will be exempted from paying the state tax for the examination of appeals against the decisions of the appeals court by the Supreme Court of Justice. The Parliament Thursday adopted a bill for introducing relevant amendments to the Civil Procedure Code, Info-Prim Neo reports. The amendments aim to regulate the cases when the applicants ask the senior court to cancel or spread out the payment of the state tax. Such a measure insures the unlimited access to justice and to a fair hearing. After examining the justificatory documents, the jury panel will decide whether to exempt the plaintiff from paying the given tax. The Government decided to work out the bill after the European Court of Human Rights found Moldova guilty of hindering a citizen’s access to justice in the case of Clionov versus Moldova. The Supreme Court of Justice did not examine the appeal filed by the plaintiff because he did not pay the state tax.
