PGO reacts to veteran Arslan Safarmatov’s statements

The Prosecutor General’s Office disapproves of the attacks by which the institution is accused of mimicking the intervention in the case of Arslan Safarmatov. The PGO reacted after the veteran told a news conference that the prosecutor general lied when he said that the case started against him, which was classed by the PACE as a political one and started by order, was remitted for revision, IPN reports.

The PGO notes that it considered the punishment imposed on citizen Safarmatov was disproportionate to the committed contravention due to the mistaken individualization of punishment. This way, the PGO back last September intervened in favor of the convict by filing an annulment appeal. The appeal was rejected by the Supreme Court of Justice on November 5, 2019.

“As to the PGO’s position on Arslan Safarmatov’s application for revision that was submitted to the SCJ and was rejected in the November 10, 2020 hearing, we note that such an application couldn’t have been supported by prosecutors as the Supreme Court of Justice can examine an application for revision only when there is a decision by which the European Court of Human Rights ascertains a violation of the basic human rights and freedoms or orders to drop the case following an amicable agreement between the state and the applicant. There was no such decision by the High Court,” said the PGO.

In a news conference held today, Nistru war veteran Arslan Safarmatov said the prosecutor general lied when he said that the case in which he is featured was remitted for revision. The veteran noted that in fact the prosecutor in charge of the case was against the revision and he is now on the outside only due to his own efforts as a result of which his remand detention was replaced with community service.
