Penalties for violating lending rules

The Government approved amendments to a number of legal acts, instituting punishments for the illegal obtaining of loans, damages or allowances, by presenting false information. Penalties will be imposed if the given actions cause damage of over 10,000 lei to financial institutions, nonblank financial organizations, savings and loan associations, or to insurance companies, Info-Prim Neo reports. The private individuals will be punished with a fine of 30,000 to 60,000 lei or two to six years’ imprisonment, while the legal entities will pay a fine of 20,000 to 60,000 lei and will be banned from performing a certain activity. The same actions that caused considerable damage will be punished with a fine of 40,000 to 60,000 lei or three to eight years’ imprisonment, in the case of private individuals, and a fine of 60,000 to 120,000 lei in the case of legal entities, which will also be banned from carrying out a certain activity or will be closed. The fines for illegal transactions on the securities market, the illegal use of privileged information on the securities market, and the sale of securities that cause considerable damage vary between 20,000 and 120,000 lei. The aim of the amendments is to adjust the Code of Administrative Offenses and the Penal Code to the laws concerning the nonblank financial market.
