Penalties for parents who do not honor parental obligations

If the placing of the child in a social service was determined by use of violence, negligence, exploitation, abandonment or neglect of the parental rights and obligations, the court of law, at the request of the local tutelage authorities, will order to collect payments from parents for covering the costs associated with the education and raising of the child in the service. This is provided in a bill that was passed by Parliament in the first reading on February 24, IPN reports.

The bill contains amendments to a number of legal acts, including the Penal Code, which will envision fines for parents who do not fulfill their parental obligations. If these intentionally avoid honoring their obligations and the child is accommodated at placement centers, the parents will be fined 15,000 to 25,000 lei. They also face up to 120 hours of community service. If the parents avoid reintegrating the child into the family, they will be fined 15,000 to 40,000 lei.

The bill provides that if one or both of the parents are groundlessly hindered from communicating with the child or educating this, those to blame will be liable to a fine of up to 20,000 lei or up to 120 hours of community service.

The draft law stipulates the child’s rights to communicate with the parents and other relatives and to have a name and family name, parents’ rights and obligations concerning the education of children and the rights of the local tutelage authorities, such as to determine the child’s domicile, and also the effects of the termination of parental rights.
