PCRM’s contestation - a new parliamentary crisis, experts

“The Constitutional Court (CC) does not have legal reasons to declare the election of Mihai Ghimpu as Speaker as unconstitutional,” political analyst Arcadie Barbarosie, the executive director of the Public Policy Institute, has told Info-Prim Neo. The PL leader was named Speaker at the first sitting of the new Parliament on August 28 by the vote of the members of the Alliance for European Integration, in the absence of the PCRM. On September 1, the Communists Party challenged the decision in the CC. The PCRM argued that the 48 Communist MPs have not participated in the vote. The chair of the first sitting, the oldest MP Ivan Calin, has not announced the election of the Head of Parliament as item of the agenda. The PCRM considers that a number of articles from the Constitution and the Parliament’s regulations have been violated. Arcadie Barbarosie said that if the CC rules in favor of the PCRM, the MPs will have to comply and abrogate the decision made on August 28. If the Court decides against the Communists Party, the legislative body will continue its work in the present format, with Mihai Ghimpu as Speaker. Victor Popa, Doctor of Constitutional Law and expert of the Institute for Development and Social Initiative (IDIS) “Viitorul”, expressed a similar view. “The Parliament will continue its work if the CC rules against the PCRM. Otherwise, the legislature will start from the very beginning as the August 28 decision will become invalid,” he said. The experts consider that the divergent political interests and incorrect interpretation of the legislative framework gave birth to controversial discussions and actions aimed at destabilizing the sociopolitical situation and causing a new parliamentary crisis Constitutional law experts, university lecturers, doctors of law and public figures will come together on September 4 to debate the PCRM’s contestation to the CC. They will analyze the expressed positions, the weight of the made accusations and will try to identify solutions to the given issue. The Constitutional Court accepted the contestation filed by the PCRM and will pronounce its judgment on September 8.
