PCRM’s challenge and Baleca played a trick on Muruianu
The reinstatement by a court of Eugen Baleca in the post of director of SA “Franzeluta” during an hour and the transfer, at the PCRM’s request, of the case concerning the validation of the seat of mayor of Chisinau to the Balti Court of Appeals are the reasons for which the Supreme Council of Magistrates suggested Parliament to dismiss the president of the Supreme Court of Justice Ion Muruianu, Info-Prim Neo reports
The proposal was made following an informative note from magistrate Alexandru Arseni. “We know the situation in Moldova as regards the judicial system and the deviations inside it. The law obliges us to examine the activity of the Supreme Court of Justice, which is the highest body that must enforce the law correctly and uniformly. The decision to transfer the case regarding the validation of the results of the mayoral elections in Chisinau to the Balti Court of Appeals, taken on July 4, is the most outrageous,” said Alexandru Arseni. According to the magistrate, while the Supreme Court of Justice was examining the Communist Party’s application to transfer the case to the Balti Court of Appeals, the party’s jurist Sergiu Sarbu was seen in the office of Ion Muruianu and of the Court’s vice president Nina Cernat.
Ion Muruianu was also accused of exerting pressure on judges. “Judges came to me and complained that they are pressurized by the administration of the Supreme Court of Justice. They asked me not to reveal their names,” said the chairman of the Supreme Council of Magistrates Nicolae Timofti. He also said that even if he was dismissed, Ion Muruianu can apply for a new term in office as president of the Supreme Court of Justice. “If he is dismissed, but remains a judge, he can take part in the contest. If he will be elected is another question,” he added.
Ion Muruianu refused to comment on the Supreme Council of Magistrate’s decision. Before deliberations, Muruianu said he exerted pressure on no one. “Not only in Moldova, civil society and the politicians are dissatisfied with decision making. Alexandru Arseni remained a party activist in his soul. He formally suspended work as a member of the Liberal Party, but his statements are similar to politicians’ statements about the latest developments in society. I never gave orders. I do not like receiving orders and tell nobody what to do for my part. I feel no remorse,” said Ion Muruianu.
The Supreme Council of Magistrate’s request was not put to the vote in Parliament on July 5. The legislative body discharged Ion Muruianu at the suggestion and on the basis of a proposal submitted by the Liberal Party. Muruianu was dismissed by the vote of 53 MPs. The Communist lawmakers did not attend the sitting.
Ion Muruianu remains for the time being a judge of the Supreme Court of Justice.
