PCRM representative sues Mihai Ghimpu
Sergiu Sarbu, former deputy head of the Presidential Office's Legal Division and member of the Certification Commission, who now acts as jurist for the Communists Party (PCRM), Monday sued Moldova's Acting President Mihai Ghimpu, Info-Prim Neo reports, quoting a communique from the PCRM.
Sarbu lodged an application with the Chisinau Court of Appeals, saying that the Caretaker President violated flagrantly the law on the public associations when he issued a decree to name new members on the Justice Ministry's Certification Commission. According to the representative of the PCRM, by that decree Mihai Ghimpu interrupted illegally the term in office of the Commission's members (including of Sergiu Sarbu), who were named for a five-year term that expires in 2012. Sarbu demands that the decree be annulled.
The communique says the present administration of the country continues to break the law and the democratic principles of the Parliament, aiming to politically subdue all the independent institutions of the state.
Last yearend, the Government named its representatives in the Certification Commission. These are Corina Cepoi, the head of the School of Advanced Journalism of the Independent Journalism Center, Aurelia Bondari, the executive director of the National Farmers Federation of Moldova AGROinform, and Elena Gritsko, the head of the Noncommercial Organizations Division of the Ministry of Justice, Info-Prim Neo reports.
The Certification Commission checks and certifies the public utility and non-profitability of the public organizations and if they and the legal entities founded by them participate in supporting political parties, electoral blocks and contenders during campaigns for the election of public authorities.
Analyzing the activities carried our by public organizations, the Commission issues them with the state certificate that allows them to be partly or fully exempted from certain taxes and payments and to benefit from concessions.
The Certification Commission is composed of nine members. Three members are named by the President of Moldova, three by the Parliament and three by the Government.
