MPs Sergiu Litvinenco and Veronica Roșca, of the group of the Action and Solidarity Party (PAS), filed two applications to the Constitutional Court in connection with the coming into force of the law for which the Government assumed responsibility. The CC is asked to shed light and respond the question if the assumption of responsibility by Government for a bill by bypassing Parliament always take place through the presence of the executive’s representative in the plenary sitting of the legislature (deliberative sitting, with quorum), either the legislative body is in an ordinary session or not, IPN reports.
According to the PAS, the April 2 sitting of Parliament where the Prime Minister was to present the bill for which the Government assumed responsibility didn’t take place as the quorum was not present. Questions whether the procedure defined by the Constitution was respected or not appeared as a result.
The second application refers to the control of the constitutionality of a number of provisions that amend the tax rates for extracting useful mineral resources, the tax for using subsoil, the tax rates for extracting natural resources and other related provisions from the Tax Code.
The PAS MPs said the challenged provisions refer to aspects that bear no relation to the object of the law for which the Government assumed responsibility – to take measures to support the citizens and entrepreneurs during the state of emergency.
The MPs of the Party “Dignity and Truth Platform” also notified the Constitutional Court of “abusive provisions of the package of laws assumed by the Government”. They request to annul the amendment concerning the visibility of tobacco products, introduction of taxed goods duty-free and introduction of taxes on natural resources.
