The Constitutional Court on April 27 is to pronounce on the constitutionality of the Parliament decisions by which the appointment of Domnica Manole as a CC judge was annulled and Boris Lupașcu was named instead of her. At the start of the meeting, the Parliament’s representative asked to recall the CC president Domnica Manole. As a result of deliberations, in which Domnica Manole didn’t take part, the other four judges decided to reject the request, IPN reports.
“The request is based on the fact that the Constitutional Court is to examine the quoted challenges that refer directly to the CC president and constitutional judge, Missis Monica Manole. The legal part of the argumentation of the recalling request refers to the laws that regulate the integrity regime and the conflict of interest,” said the Parliament’s representative Lilian Enciu, making reference to Article 27 of the Constitutional Jurisdiction Code and also to the fact that the reaction messages of the foreign partners were published on the Court’s website.
PAS MP Sergiu Litvinenco and PPPDA MP Dinu Plîngău, who are the authors of the challenge, asked to reject the recalling request, arguing this is unsupported.
As a result of deliberations, the constitutional judges decided to reject the request of the Parliament’s representative.
