The acting president of the Superior Council of Magistracy Dorel Musteață and judge Gennady Plămădeală were appointed judges at the Supreme Court of Justice (SCJ) up to the age limit of 65, IPN reports.
In the November 4 sitting of Parliament, Ghenady Plămădeală was named SCJ judge by the votes of 55MPs (53 PAS MPs and two BCS MPs), while Dorel Musteață was voted by 52 PAS MPs. The decision takes effect when it is adopted. Candidate Oxana Robu garnered only one vote.
In his speech, MP of the Bloc of Communists and Socialists Vasile Bolea said the government tries to repay the debts owed to particular persons by naming them to posts, including at SCJ. In its meeting, the responsible commission questioned one of the candidates during half an hour, while another candidate during five minutes only. Dorel Musteață was used in the vengeance against the Prosecutor General’s Office, including to remove its head. By such actions, the promised justice sector reform cannot be done.
Under the legislation, the judges at the Supreme Court of Justice are confirmed by Parliament at the suggestion of the Superior Council of Magistracy.
The extraparliamentary party “Dignity and Truth Platform” issued a statement, saying that Dorel Musteață is one of the most controversial candidates for SCJ judge. During the state capture, he managed to swiftly build a career, showing his obedience to the political factors: “Plahotniuc – Dodon”. “The candidacy of Dorel Musteață generates serious questions as to the legality of the procedures for appointing judges at SCJ, harms the rule of law and meritocracy principles and gives to the whole judicial system a negative signal that a successful carrier in the system is possible only by political affiliation and obedience,” runs the statement.
