The legislative body will be able to amend the legislation on the work of the Constitutional Court (CC) only by modifying the Constitution, unaffiliated lawmaker Sergiu Sarbu said, making reference to the argumentation provided by the Court over a decision passed last week. Liberal-Democratic MP Valeriu Streley, referring to the same provision, said that other states’ experience in the field should be analyzed, IPN reports.
The CC on May 22 made public its argumentation on the decision pronounced on May 16, when it ruled that four of the six constitutional judges can ensure the quorum no matter which authority designated them. In its argumentation, the Court says that any initiative that limits the rights of the constitutional judges will be declared unconstitutional.
According to Sergiu Sarbu, now the bill providing for the dismissal of constitutional judges, which was retuned by the head of state to Parliament, has only one fate – to be annulled. Otherwise, if the proposed amendments are re-voted, they will be invalidated.
