Parliament adopts new Law on Notarial Activity

The notarial activity will be freer, but also more credible, while the conditions of entering the profession of notary will be more complex. Such provisions are contained in a new Law on Notarial Activity that was adopted by Parliament in the first reading, IPN reports.

When presenting the bill, Deputy Minister of Justice Eduard Serbenco said this forms part of the justice sector reform strategy. The bill institutes the term ‘notary on probation’. The probation period will be extended from 12 to 18 months. After probation, the probationer will take a test to see if this qualifies for the post of notary.

A Notarial Chamber will be set up as a regulatory body in the field. There will be constituted the general assembly of notaries and the ethics commission and adopted a new deontological code. A Credibility Fund will be created of notaries’ contributions. It will be managed by an administration board that will work within the Notarial Chamber. The Chamber will carry out inspections at notary’s offices once in three years. The Ministry of Justice will be able to perform unplanned inspections, based on complaints.

According to Eduard Serbenco, the implementation of this law does not necessitate financial resources from the public budget. The bill was consulted with the authorities and civil society.
