Orphan deprived of social insurance
The Centre for Children’s Rights (CDC) has appeal in the Balti Court of Appeals the decision of the Floresti District Court to annul the payment of the social insurance for a young woman from Lunga, Floresti. Thus the orphan girl, aged 19, has been deprived of the only source of subsisting, Info-Prim Neo reports.
According to the CSC consultant, Irina Codrean, earlier the local Public Guardian annulled, via a decision, the social insurance for the young women, who is part of the category of adopted children under guardianship and trusteeship. The girl requested the court to annul the decision of the authority, considering that the social insurance has been cancelled illegally, but the Floresti Court maintained in force the decision of the Local Public Guardian.
The young women lost her mother at an early age and her father was announced fugitive for a crime. The girl has been educated by her grandfathers. Until December 2005, she benefited from a social insurance of 200 lei for adopted children under guardianship and trusteeship. On 9 December 2005, the Local Public Guardian of Lunga adopted a decision cancelling the payments on grounds that the girl reached the legal age.
At present, the young women studies at the “Alecu Russo” University in Balti and does not have the financial sources for subsistence. CDC Lawyers CDC assert that he annulment of the social insurance is illegal because, according to the Decision for the approval of the Regulations on conditions for establishing and payment of indemnities for adopted children under guardianship and trusteeship, allocations for them are paid till they reach the legal age, but, in case that they continue their studies in education institutions – until graduating from these institutions.
CDC, being a nongovernmental organisation which offers legal protection as well as other kinds of support to children and youth, considers that the decision of the court is unfounded. The organisation will request the annulment of this decision in the Court of Appeals.
