One more year when officials get away with irregularities in income declarations

Public office holders who write fake data in income declarations or present them with delay cannot be punished as the National Integrity Commission hasn’t been created yet, notes Marina Kalughin, expert of the Center for Analysis and Corruption Prevention (CAPC). The Law creating this commission came into effect on March 1. The commission will verify data on property and income declarations submitted by public office holders, judges, prosecutors and other people in positions of authority. However the Law stipulates a one year deadline for verifying declarations and three months for initiating administrative proceedings if irregularities are found. These deadlines can’t be exceeded because this would violate the declarers' rights. “The commission hasn’t been created yet and the whole process is halted”, the CAPC expert told reporters. Even if the commission is created today, it will begin its work after a while, as it needs headquarters, employees and so on. “This year, no one will be called to account for violating the legislation on income declarations”, said Marina Kalughin. Previously, there have been several attempts to punish officials who violated the regulation on income declarations, but all of them were acquitted. The new law stipulates administrative penalties for failure to submit declarations, for submitting it with delay or with fake data. Incomplete or inexact data in declarations is punishable by 12,000 lei or one year in prison. The national deadline for submitting income returns is March 31.
