The Minister of Justice, Olesea Stamate, argues that if the Superior Council of Prosecutors (CSP) continues the previously initiated contest for the selection of the new Prosecutor General, then this contest will be illegal. This is due to the Parliament’s amendments to the Law on Prosecutor's Office, for the new provisions establish a new method of selecting the candidate for the general prosecutor's position. The statement was made by the Minister of Justice on "Time of Expertise" programme, Jurnal TV, IPN reports.
"They break the law if they continue the contest because the draft law stipulates clearly in the final and transitory provisions that any contest unfolding at the time of the approval of this law shall be ceased. When this draft is approved by the Parliament, they shall be obligated to suspend the ongoing contest”, declared Olesea Stamate.
Yesterday evening, the Parliament voted to amend the Law on the Prosecutor's Office, in the version proposed by the Ministry of Justice and with the amendments proposed by the MPs. The law was passed in the second reading. Thus, the candidate for the position of Prosecutor General shall be selected by CSP based on a list proposed by the Ministry of Justice.
The CSP announced last week that seven candidates had submitted their applications for the Prosecutor General position.
