Nothing can be changed in justice as long as those who fabricate cases do not leave, lawyer

“Nothing can be changed in the justice sector as long as the teams of prosecutors and judges who fabricate criminal cases by order or in order to enrich themselves do not leave their posts,” said university teacher Ilie Rotaru, who is also a lawyer. Being during 15 years under criminal investigations that he considers illegal, Ilie Rotaru said that no matter which of the politicians is in power, those who fabricate cases keep their posts, with small exceptions.

In a news conference at IPN, Ilie Rotaru said that as usual the cases are fabricated by order of politicians, oligarchs and businessmen who want to remove their opponents. “These are also fabricated because the prosecutor wants to increase their so-called authority before the superiors so as to obtain more important posts or to enrich themselves,” stated Ilie Rotaru.

The lawyer noted that in 2012, he started to examine a number of criminal cases and studied over 100 cases until 2019. “I realized that the largest part of these cases, over 80%, can be easily shown to be fabricated. So, the people involved in these were convicted illegally. In 20% of the cases, we can say that particular mistakes were made. But in most of the cases, and in even those 20%, the people could have been acquitted, if the laws of the Republic of Moldova had been strictly obeyed,” stated Ilie Rotaru.

According to him, one of the problems of the judicial system is the fact that the examination of appeals at the Supreme Court of Justice takes place in the absence of the parties. The restoring of the practice of examining appeals in the presence of thw parties and modification of the composition of the Criminal Board of the SCJ (current judges should be replaced by professionals) would be steps towards reforming the justice system.

“We should think what to do with the justice sector reform. I expect that the future President of the country will be not Mister Dodon, but Mister Usatyi or Maia Sandu and one of these two will start to really reform the justice sector after they are installed. Without the reformation of justice, our country cannot develop normally,” stated Ilie Rotaru.

“The working practice of the prosecution service, first of all of the prosecutor general and the Prosecutor General’s Office, should be modified. They pursue such a practice, which probably comes from Voronin and Plahotniuc, that the case should be sent to court at any cost and a conviction sentence should be obtained. If such a practice is not changed, nothing good will happen in the Republic of Moldova.”
