New law on notarial activity takes effect Feb. 26

The new law on the organization of the activity of notaries, of April 14, 20016, comes into force on February 26. This specifies more complex conditions for being allowed to work as a notary, IPN reports.

The law stipulates the tem of ‘notary on probation’. The probation for a notary will last for 18 months, while for the holders of a Doctor of Law diploma for three months. The person who completes the professional probation will take a qualification exam to become a notary before the Licensing Commission. This exam is staged at most two times a year.

The license for working as a notary is issued for 450 lei. The money is paid into the treasury account of the Ministry of Justice. The persons who have a license for working as a notary when the given law takes effect can work further based on this. At the same time, within six months of the coming into force of the law, the notaries will take all the necessary measures to meet the requirements of the law.

The law provides that the Notarial Chamber, which is the notarial activity regulatory body, will carry out inspections once in three years, while the Ministry of Justice will be able to perform surprise inspections, based on complaints.

There will be instituted the General Assembly of Notaries and the Ethic Commission and adopted a Deontological Code. A Credibility Fund will be set up of notaries’ contributions. This will be managed by an administration board that will work within the Notarial Chamber.
