National Council for Guaranteed Legal Assistance will meet by next April
A public lawyer or a paralawyer will provide services to the persons that need primary and qualified legal assistance, but do not have the necessary resources.
The first meeting of the National Council for Guaranteed Legal Assistance – body in charge of the implementation of policies in the area, is to take place within six months, ten days after designating the seven members of the Council – by two on behalf of the Ministry of Justice and of the Bar Association and by one representing the Superior Council of Magistrates, the Ministry of Finance and public organisations or the academic environment.
The law on state guaranteed legal assistance stipulates the conditions, volume and way of providing legal assistance to the persons in a difficult financial situation. The regulation published in the last number of the Official Gazette will come into force while the necessary conditions are created, but not later than next summer (July 1, 2008), except for some provisions that will take effect by January 2012.
According to authors, the aim of the law is to ensure a free and equal access to qualified legal assistance for all the persons in order to protect the rights and fundamental freedoms and other legal interests.
The law on state guaranteed legal assistance was formulated by the Ministry of Justice in cooperation with Soros-Moldova Foundation, experts and partners of Open Society Justice, the Council of Europe, the OSCE Mission to Moldova, ABA Rule of Law Initiative in Moldova, Justice UK etc.
The commitments on the provision of free access to justice are included in the Economic Growth and Poverty Reduction Strategy, the EU-Moldova Action Plan, and Moldova’s Millennium Challenge Corporation Threshold Country Programme.
