Municipality will resume distributing plots for private constructions

The Municipality will resume the process of distributing plots for private residential constructions. The head of the Land Department of Chisinau City Hall, Nicolae Craciun claims that local authorities have the legal right to allocate plots for private constructions. Starting from 2003, this process was ceased, because legal authorities discovered illegalities in the process of distribution of hundreds of plots for building houses. According to Craciun, the article no. 84 of the Law on local public administration, which is a general one, provides for the repartition of plots via auctions. At the same time, art. 11 of the Land Code, which is a specific law, regulates the repartition of plots for erecting private houses, including the mechanism of allocation. Nicolae Craciun said, during the last meeting of the Municipal Council of Chisinau, that these two laws contradict each other, but another law, the Law on normative acts, that regulates the conflict between laws, stipulates that in such cases the specific law is above. Thus, according to the head of the Land Department, MCC can resume the allocation of plots for private construction. Municipal councilors solicited the Land Department to present, by the end of November, a regulation which would stipulate the categories of persons that can benefit from plots. At the same time, councilors requested that the presentation of the Concept on administration of Landed property of Chisinau Municipality is hastened. According to the Land Department, at the moment there is no data on what is the number of available plots for individual constructions. In the process of drafting the General Urban Plan new plots will be identified for building houses.
