It is not right to consider that the difficulties are due to the imperfect legislation as the major problems in Moldova reside in the political culture and the will of the political class, considers political analyst Igor Botan, the director of the Association for Participative Democracy (ADEPT). This is one of the conclusions of the study of the electoral framework and context in Moldova during the parliamentary elections carried out by ADEPT. The study was presented on October 13, Info-Prim Neo reports. The “Electoral Context 2009” study is a synthesis of the electoral events and it focuses on the problems that caused the conflicts and led to the destabilization of the political situation in Moldova. The study is based on the monitoring reports on the two parliamentary elections, of April 5 and July 29, prepared by national and international observers. In order to make recommendations for removing the shortcomings that generate confusion and conflicts, the authors of the study analyzed the political developments before the ordinary and early legislative elections and their impact on the electoral process. A separate chapter is devoted to the analysis of the electoral legislation, on political parties and the mass media. The experts tried to identify the shortcomings hindering the implementation of the legislation. Igor Botan said the electoral contenders filed contesting applications because the legislation is imperfect and it is implemented inappropriately. “New parliamentary elections are coming and we do not know what the outcome of these elections will be. In the study, we centered on the general context in order to show that there are problems in the society. We tried to identify the roots of these problems and expressed our views so that those interested – the political parties, the Central Election Commission and other state bodies – could draw conclusions,” Igor Botan said. CEC secretary Iurie Ciocan reiterated the necessity of amending the Electoral Code. “It is not the right moment to speak about concrete changes, but the Central Election Commission is preparing a set of proposals that will be submitted to the Government and the Parliament,” Ciocan said, stressing that the modifications focus on technical and organizational aspects. Independent expert Cornel Gurin said that though the law on the political parties contains new elements and lacks drawbacks, its efficiency is open to question. He also said that the public mass media had an inadequate behavior, while the politically-unaffiliated media outlets had been harassed. Expert Ion Creanga, the head of the Legal Division of the Parliament's Apparatus, said that a major problem in both of the electoral campaigns was the registers of voters. “The legislature must devote attention to the electoral rolls and the electoral bodies and modify the legislature so as to institutionalize certain procedures, regulations and norms that would enable to remove the obstacles encountered during the two campaigns,” the expert said.
