Moldovans go to ECHR 6.5 times more often than they do in EU on average, LRCM

The Moldovans apply to the European Court of Human Rights (ECHR) 6.5 times more often compared to the European average. As many as 653 applications were registered against Moldova last year, 2% up on 2022, shows an analytical note presented by the Legal Resources Centre from  Moldova (LRCM) in a press conference at IPN.

According to Daniel Goinic, director of the Center’s Human Rights Program, the number of applications  is very high against the country’s population, Moldova ranking fifth out of the 46 Council of Europe member states. Moldova is also among the countries with the largest number of human rights violations.

In total, by the end of last year, the ECHR passed 599 judgments on cases featuring Moldova, where a total of 786 human rights violations were identified. In 2023, 24 judgments were pronounced - the lowest number in the last five years. The identified violations refer largely to the years 2009 to 2015. 

During 26 years, the Court has registered over 17,000 applications against Moldova. On December 31, 2023, 1,149 applications were pending. By the number of pending applications, Moldova ranks 10th out of 46 Council of Europe member states.

In 2023, the European Court of Human Rights registered a total of 34,600 applications, this number being the lowest one in the last ten years. The decline is particularly due to the decrease in the number of applications coming from countries such as the Russian Federation, Turkey, Serbia and Greece. Even though the Court continues to receive applications against Russia, the number is very small. In 2023 there were 1,695 applications, as against 6,000 in 2022.

In 2023, the Court passed 1,140 judgments, a decrease of 13% on 2012. Daniel Goinic noted that most of the pronounced judgments refer to the Russian Federation, Turkey and Ukraine. The Republic of Moldova, according to the number of passed judgments, ranks eleventh, which is a constant place.

“We were somewhat astonished because we identified states that in 2023 had no conviction ruling. Here I want to mention Sweden, Finland and Ireland, which have no conviction judgment, while such countries as the UK and Germany have one or up to three conviction decisions. Respectively, here we can highlight the efficiency of the justice system in the given countries,” stated Daniel Goinic, director of the Human Rights Program of the LRCM.
