MoJ finalizes Bill on disciplinary liability of judges

The Ministry of Justice has finished working on the Bill concerning the disciplinary liability of judges. The Bill contains, among other provisions, an augmented list of disciplinary violations, Info-Prim Neo reports. According to a press release from the Ministry of Justice, the list of disciplinary violations was supplemented with provisions concerning the failure to meet procedural time limits, solicitations to authorities made in personal interests, involvement in public activities of political nature and manifestations of political convictions in court, and improper attitudes towards colleagues, lawyers, experts, witnesses and other participants in court proceedings. The prescription period for holding a judge accountable for disciplinary violations was extended from one year to two years. The the number of members on the Disciplinary Committee hearing such violations was increased from 10 to 11. The Disciplinary Committee will also include civil society members. The Bill concerning the disciplinary liability of judges was developed by a task force created under a ministerial ordinance in September 2012. It included MoJ members, members of the Superior Magistracy Council and of the Disciplinary Committee, representatives of the academia and civil society members, who took into consideration the relevant experience of such states as Germany, Romania, Lithuania and Poland, as well as relevant recommendations from the Council of Europe's specialized organizations.
