Mocanu brothers are denied trial in Romania

Although there is a law in Moldova providing for international legal assistance in criminal matters, it appears not to be working in the case of the Mocanu brothers, said Ion Dron, the lawyer for Adrian and Roman Mocanu, the sons of the former presidential advisor Sergiu Mocanu. According to Ion Dron, the prosecutor conducting the case refused to turn the investigative files over to the Romanian bodies, despite the legal provisions which require him to do that if the extradition request of the Moldovan authorities is rejected. “We find ourselves in this ridiculous situation of having to solicit Romania to demand that Moldova transfer the investigation (...) to the Romania side, as required by the law”, Dron told a news conference on Friday. The lawyer said an inquiry is needed to verify whether the refusal of the prosecutor was due to incompetence or ill will. The brothers Roman and Adrian Mocanu are suspected of beating a young man at a night club in August last year. After being released from custody on condition of not leaving Chisinau, the brothers, using their status as Romanian citizens, jumped over the fence of the Romanian Embassy to seek asylum. Later Romania's Justice Ministry rejected Moldova's extradition request. While the Mocanu family claims the reasons for the persecution of the brothers are merely political, Roman and Adrian are still hiding out at the Romanian Embassy in Chisinau waiting for better days.
