Entrepreneurs will be able to challenge the state inspection decisions in court and to this way prevent unjustified losses of time and money. This is provided in a bill to amend a number of normative documents that regulate the control of entrepreneurial activities in Moldova. The draft law was presented by Deputy Prime Minister Dumitru Alaiba, Minister of Economic Development and Digitization, in a news conference, IPN reports.

According to the minister, the entrepreneurs most often invoke problems related to state inspections, to the way in which these are conducted, to the behavior of inspectors and the existing corruption risks. The proposed amendments introduce penalties for abuse on the part of inspectors and improve internal supervision at inspection bodies. They clearly differentiate between “recommendations” and “instructions” formulated by inspectors and introduce “crisis management plans” for guiding inspections in emergency situations.

The bill also provides for the unification of annual inspection plans, taking into account different types of business entities and the risks. The conditions for surprise inspections are reviewed and specific reasons for inspections at dishonest business entities that intentionally avoid inspections are introduced. In case of evident violations of procedures, the inspection can be stopped so as to save time and resources. The inspection can be suspended in particular situations, such as waiting of results of lab tests.

According to Dumitru Alaiba, the bill is designed to contribute to more efficient and clear inspections, including in the case of inspection bodies so that these work transparently, in accordance with the realities and based on risk factors. The draft law will be published on particip.gov.md for public consultations and will be then submitted to the Cabinet and Parliament for consideration.
