Mihai Ghimpu maintains Nicolae Timofti must name acting PM

The Liberal Party head Mihai Ghimpu insists that President Nicolae Timofti should name one of the Cabinet members as acting Prime Minister. On April 4 he told the journalists that this obligation is stipulated in Article 100 and 101 in the Constitution. He said he will appeal to the Constitutional Court again if Nicolae Timofti does not do it, IPN reports.

Article 100 of the supreme law says the Cabinet stops existing in case of dismissal, revocation, or incompatibility, while Article 101 says that if the Prime Minister is unable to fulfill his duties or dies, the head of state designates a member of the Cabinet as acting Prime Minister, who serves until a new Government is formed.

Mihai Ghimpu said he will ask the Constitutional Court to interpret the statement ‘if the Prime Minister is unable to fulfill his duties’.

The Liberal urged the head of state not to yield to the challenges of his consultants or the former Prime Minister and to implement the decisions of the Constitutional Court, which is the only institution empowered to interpret the Constitution.

On the other hand, Nicolae Timofti said that these decisions of 1999 and 2000 are no longer valid as they were adopted based on the constitutional norm of that period, which was modified meanwhile.

The Filat Government fell in a no confidence vote in Parliament on March 5.
