Method of calculating allowance for temporary incapacity for work

The insured person’s right to an allowance for temporary incapacity for work is provided when the person loses the insured income for the whole period of the medical leave at all the units where this works and if this confirms a complete insurance period of at least three years or an insurance period of at least nine months during the last 24 months prior to the occurrence of the insured risk, which is of disease. The allowance for temporary incapacity for work caused by tuberculosis, AIDS or cancer is set regardless of the length of the insurance period, IPN reports.

The allowances for temporary incapacity for work in the case of common illnesses or accidents that are not relate to work are paid by the National House of Social Insurance starting with the sixth calendar day of temporary incapacity for work. In the case of several periods of temporary incapacity for work, the allowance is paid starting with the first day after the expiry of 15 cumulative days paid from the employer’s funds.

According to the House, the monthly allowance for temporary incapacity for work is set in a differentiated way, depending on the length of the insurance period:
a) 60% of the calculation basis in the case of an insurance period of up to five years;
b) 70% of the calculation basis in the case of an insurance period of five to eight years;
c) 90% of the calculation basis in the case of an insurance period of over eight years.

The allowance for temporary incapacity for work caused by tuberculosis, AIDS or cancer represents 100% of the calculation basis.

The calculation basis for the temporary incapacity for work paid from the state social insurance budget represents the average monthly income for the past 12 calendar months prior to the month when the insured risks occurs, if contributions had been paid from this income by the date the allowance is set.

In the case of insured persons for whom the calculation basis is absent, the basis represents 35% of the forecast average monthly pay agreed by the Government for the year in which the insured risk occurred.

The calculation basis for the allowance for temporary incapacity for work caused by tuberculosis, AIDS or cancer for insured persons who do not have the necessary insurance period of three years in total or nine months during the last 24 months prior to the occurrence of the insured risk represents 35% of the forecast average monthly pay agreed by the Government for the year in which the insured risk occurred.

The official average monthly salary for 2021 was approved by Government decision at 8,716 lei.
