The marriage could be ended by notaries by the mutual consent of the husband and wife. The Parliament’s legal commission for appointments and immunities on September 26 examined a draft new law on the notarial procedure, IPN reports.
The application for divorce will be compiled based on a model approved by the Ministry of Justice. This will specify the method of parents’ participation in the education and maintaining of common minor children, their place of residence, the size of the child maintenance benefit that will be paid by the husband or the division of the common property obtained by the spouses while being married.
In accordance with the Family Code, the notary will give the spouses 30 days to withdraw the application for divorce. When the given period expires, the notary will issue the decision on the ending of the marriage by the mutual consent of the sides within three days and will send it to the local civil status body for the civil status document to be registered.
The bill is to be debated and passed in a plenary siting of Parliament.
