The National Alternative Movement (MAN) Party requested the Constitutional Court to evaluate the constitutionality of the new provisions of the Education Code.

The new constitutional review request comes after the Constitutional Court on December 12 rejected a similar request filed on September 7 by MP Gaik Vartanean, IPN reports. “Unfortunately, the court did not take into account the issues raised by us, but there were separate opinions expressed by two judges. In addition, in today’s request we invoked new reasons and aspects related to the fact that the central authorities, the ruling party, seek to take full control of the education system in the country, violating a number of legal principles and norms,” said the MP.

The authors of the request warn about the threat to local autonomy generated by the provisions of Article II, paragraphs (2) to (9) of the law adopted on August 17. They pointed out that this change can lead to a series of abuses, allowing dismissals and arbitrary appointments in educational institutions, with serious consequences for the integrity and independence of the education system.

“After the Constitutional Court passed its decision on December 12, a large number of education division heads in districts and municipalities of the country are to be discharged and the Ministry of Education is to appoint caretaker heads for a period of six months. Subsequently, through an equally abusive regulation, a Commission will be formed to organize the contests for appointing the heads of education divisions. Six out of nine members of the Commission will be named by the Ministry of Education. This is direct interference in the work of local public authorities. The position of local authorities is ignored. Through such decisions, they do nothing but forcibly take over all the educational institutions in the country,” said Andrei Pavaloi, a MAN member.
