The list of economic agents with debts will be published on the MConnect Interoperability Platform. The platform will contain data on both debts to the State Tax Service and those set by court decisions. This is provided in a draft law that was given a final reading by Parliament, IPN reports.

The database of economic agents that have debts will be created by the e-Government Agency.

Entrepreneurs will also be able to report the bad payers with whom they have commercial relations. This information will have to be proven and the reporting person will take responsibility for the information submitted.

In this way, the authorities aim to ensure transparency and predictability in the process of making payments in commercial transactions.

The authors of the document also propose a payment term between professionals of no more than 60 days, in order to ensure a predictable and fair framework for both parties. In the case of contractual relations between professionals and contracting authorities, it is proposed that the legal payment term should not exceed 30 days.

The legislative initiative contains provisions regarding the compensation of debt recovery costs. Creditors could claim a minimum compensation of €40 for each day of delay, in addition to other expenses related to a possible foreclosure.

If the debtor is late in fulfilling the payment obligation, the creditor could obtain a court order in accordance with the Code of Civil Procedure’s provisions regarding the ordinance procedure, which is a simplified procedure.
