Legislative shortcomings leave violent protesters unpunished

Most of the participants in the April 2009 mass disorders did not stand trial because they could not be charged. Prosecutor Sergiu Rosu stated for Info-Prim Neo that under the amendments to the Penal Code passed last May only the organizers of mass disorders are punished, not yet the participants. “I think those amendments were inappropriate. Certain aspects were neglected and we cannot hold accountable the persons who took part in the protests, threw stones at the police or devastated the state buildings,” said the prosecutor. “Even if the given amendments were annulled, the offenses committed by protesters in April 2009 could not be punished.” According to Sergiu Rosu, a part of the cases started over the April 2009 protests were closed as the parties reached amicable settlements. Other cases were closed after the persons accepted their blame and inflicted administrative penalties or because the guilt of the person could not be proven. The prosecutor said over 60 of the protesters taken to police stations after those events had a criminal record. A part of them were convicted of theft. A number of cases are still being tried in court.
