Independent City councilor Mihai Roşcovan believes that the Parliament of Republic of Moldova has an inconsistent attitude towards the reform in the local public administration area. He arrived at this conclusion based on the recent documents emitted by the legislative instance. Therefore, according to Roscovan, the changes in the Law nr 123-XV from March 18 2003 regarding local public administration from Chisinau published in one of the recent issues of The Official Monitor are not present in the project of the new edition of the Law regarding local public administration, which was recently voted by the Parliament. Usually, the latter modification of any law implies the abrogation of this law along with any published modifications. It seems that these changes were not made to improve the current legal basis, but to test the public and international opinion to the intentions of the government to change the current structure of the public municipal authorities, concludes Roscovan. The changes require the creation of 5 regional Councils in Chisinau city, together with 5 regional mayors that are chosen through elections, yet these changes are contradictory and do not set the obligations of the regional councils towards the municipal council. Therefore, article 62 line (2) states that organization and functions of the municipal public administration are established by the legislation regarding local authorities of first and second level, while article 64 lays down that the Municipal Council carry the function of local councils, meaning a authorization of first level. The responsibilities of local regional councils are submissive or equal to the authority of the Municipal Council. According to article 66, the decisions of the Municipal Council or the normative orders of the City Mayor are mandatory for the regional public authority, which means the authority of the regional administration is strictly limited. Thus, on one hand the regional public administration are considered fully autonomic structures of first level, on the other hand they are obedient to the municipal structure’s decisions. Mihai Roscovan believes that impairment from the principle of local autonomy combined with the mentioned inconsistencies will create malfunctions in the process of local public administration of the municipal. According to Roscovan, the legislative changes regarding the assembly of regional councils and election of regional mayors in Chisinau have no real economic or social justification. These changes imply the creation of the 1st level of local public administration within the city, setting the boundaries of jurisdictions between the Municipal Council and the regional councils, the financing of these jurisdictions, which implies the creation of new administrative structures with separate and independent budgets. Roscovan also mentions that the regions of Chisinau of different economic potential and of different population sizes. For example, in the Ciocana region live approx. 80 thousand persons, while in Botanica live over 190 thousand. A great number of these persons work and pay taxes in a different region than the ones they live in. So there will be necessary a redistribution of profits. And this in the background where Moldova still has issues with financial distribution from the 1st level of public administration to the 2nd. These are the main reasons why inadequate resource repartition will cause conflicts regional mayors and councils with Genral Mayor and Municipal Council. Another reason why this project is bad news is that the new public administration structure from Chisinau will be more expensive due to the increased number of regional councilors and other civil servants. At this point the annual expenses of a councilor are rated at MDL 5 thousand and for a civil servant the wages are minimum MDL 25 thousand. In the new administration scheme, the number of councilors with double, and the number of civil servants will increase with minimum 20%. The expenses will also go up because the current reorganization of the Municipal Council are not taking into consideration the changes. The opinion of the independent council Mihai Roşcovan is that although the motto is to “allow the citizens to take part in the administration of the local issues”, the changes that will soon be implemented seek to reestablish the soviet system of division and administration, therefore increasing the influence of the government on local decisions.
