Lawyer Veaceslav Turcan says that legal practice in Moldova must change, citing the rulings of the European Court for Human Rights as an argument in this regard, Info-Prim Neo reports. He is the lawyer of brothers Pavel and Vitalie Levinta, who were accused of being members of national syndicate. They were sentenced to 20 years in jail. The ECHR ruled twice that the evidence in this case was obtained through torture. Ten years from the initial sentence, the brothers were freed and the case sent for re-examination. The lawyer told the press that the Court of Appeal will announce its sentence this week. “I think they must be acquitted. The ECHR confirmed that the information gathered by the investigators cannot be used. If the Levinta brothers aren’t acquitted, we’ll go to the ECHR and I’m sure the country will lose yet another trial”, said Veaceslav Turcan. In 2010, the ECHR ruled that Moldovan authorities arrested the Levinta brothers illegally. The brothers were paid €16,000 for only two months in prison. “We understand that the state budget will take a big blow should they be paid for 10 years of illegal imprisonment”, he said. Should the Court of Appeal rule that the duo have been sentenced and jailed illegally, the government will have to pay them damages for the arrest period. The lawyer says he will go to the Superior Justice Court and the European Court of Human Rights if the judges don’t acquit the brothers. Veaceslav Turcan says that lawyers from other CIS countries cite the ECHR rulings against Moldova as precedents in the files they administer. One of the sentenced brothers, Pavel Levinta, declared that the prosecutors still insist on their arrest even if they lack any evidence. He thinks that someone is interested in jailing them and this someone is intimidating the witnesses. Pavel Levinta claims that two murder attempts were committed in jail against him and his brother.
