Legal framework regulating public-private partnerships will be reviewed

The Government approved amendments to a number of laws in order to adjust them to the law on the public-private partnership. According to Deputy Prime Minister and Minister of Economy Valeriu Lazar, the amendments institutionalize the public-private partnerships and ensure their functioning, Info-Prim Neo reports. Among the amended laws are the law on concession, the law on the public property of the territorial administrative units, the law on public amenity services and the law on the local public administration. Amendments were also introduced to the law on the public-private partnership. They delimit the powers of the central and local public authorities in the filed and define the powers of the Public Property Agency with the Ministry of Economy. The Public Property Agency will monitor and assess the accomplishments of the public-private partnerships and will check how the public partners observe the procedures for selecting the private partners. Valeriu Lazar said the standard procedures that will ensure the functioning of the public-private partnerships will be described in separate regulations. There will be also compiled a guide about public-private partnerships. The law on the public-private partnership was adopted in the summer of 2008. On May 8, 2009, there was created a public-private partnership division at the Public Property Agency. However, no public-private partnership has been established so far. The Ministry of Economy explains that there are no clear regulations that would be based on the economic developments in the work of the public-private partnerships.
