The lawyers for the wine complex Dionysos-Mereni said the judges who are examining the criminal case involving the company do it tendentiously and apply other standards than those stipulated in the Penal Procedure Code, violating also the human rights.
In a news conference at IPN, lawyer Marin Domenti said the criminal proceedings against Dionysos-Mereni were instituted after the company went to court to regain its property to the value of about 3 million lei that was illegally taken by Univers-Vin. For its part, the latter accused Dionysos-Mereni of swindle attempt and abuse of office.
Initially, the prosecutor general signed an order to drop the case, but Univers-Vin challenged the order in court, asking to annul this and to hold accountable the representatives of Dionysos-Mereni by sentencing them to jail terms for daring to sue Univers-Vin.
According to the lawyers, the case was tried with a series of procedural violations. It should have been examined during 30 days, but has been pending at the Appeals Court for a year already, since August 2021. The panel of judges for two times tried to pass judgment and for two times resumed the examination of the case.
Also, the panel of judges rejected all the requests of the lawyers for Dionysos-Mereni, including to attach to the case official documents showing that the Prosecutor General’s Office’s order to drop the criminal case is legal. The judges considered the person’s right to defense can be violated and held the hearing in the absence of the lawyer, who could not show up for objective reasons.
Another lawyer for the company, Maxim Belinschii, said the judges who are dealing with the appeal apply other standards than those specified in the Penal Procedure Code. It is a paradox, but the judges who realize that this is not a criminal case have examined the appeal for a year.
The lawyers consider this is a case started by order and are hopeful that it will be dropped.
