Lawyer for German citizen sends open letter to prosecutor general

Lawyer Angela Procopciuc wrote an open letter addressed to Prosecutor General Alexandr Stoianoglo and the senior state authorities, asking that these should monitor the case of her client – a German citizen called Friedrich Maier. According to the lawyer, a number of illegal decisions were passed against the German citizen by which the rights stipulated in the European Convention on Human Rights were violated.

In a news conference at IPN, Angela Procopciuc said that by this letter she requests the prosecutor general to start investigations into the illegalities committed by the then anticorruption prosecutors Viorel Morari and Dorin Compan and by ex-Prosecutor General Eduard Harunjen in relation to the citizen of the EU Friedrich Maier.

According to Angela Procopciuc, her client has been persecuted by Moldovan investigation bodies for over 13 years. “He was investigated and arrested for two times. He was put on the wanted list for three times and detained for three times. He served 30 days of arrest for two times. “These persons not only violated the rights of my client, but also committed crimes that are stipulated by the Penal Code,” stated the lawyer.

More exactly, prosecutor Viorel Morari separated the materials of the case into a separate procedure and legal action under the direction of prosecutor Dorin Compan was taken in two days. The lawyer said that by charging her client in his absence, Dorin Compan violated the provision saying the dropping of charges or of a case prevents the repeated charging of the same person for the same offense.

Angela Procopciuc noted that her client was to be given a legal status when legal action was taken, i.e. on August 8, 2007, when the separation took place. This way, the period of three months of the indictment expired on November 8, 2007, when the prosecution body was to close the case against her client.

Prosecutor Dorin Compan abusively issued a number of ordinances to list Friedrich Maier as wanted in the absence of preventive measures. Abuses were also committed in the examination of Friederich Maier’s complaint by which he requested the Moldovan authorities to take legal action against Dorin Compan over threatening and asking of €70,000 bribe for dropping the charges against him.“Prosecutor Viorel Morari, alongside the judge of inquiry, reached the conclusion that Friedrich Maier’s complaint didn’t meet the form and content conditions,” stated the lawyer.

Through her letter, she also asks to transfer the criminal case started against Friedrich Maier to the German authorities and to accept her client’s complaint about threatening and bribery. “The prosecutor general could possibly take over this case and the defense’s requests would be heard,” said Angela Procopciuc.

The letter in the original will be sent today to Parliament, the Presidential Office, the Government and the Ombudsman’s Office.
