Lawyer Vitalie Taulean in a news conference at IPN said that in only three months of the release of his client Vladislav Cucer from jail before time, based on a ruling by the Buiucani Court of December 26, 2016, on January 24 the Appeals Court passed an illegal and unfounded judgment. By this, his client is obliged to serve the remaining time in jail, the application of the administration of Penitentiary No. 9, which provided conclusive evidence showing that Vladislav Cucer corrected his behavior and firmly set off on the path to reeducation, being rejected as groundless.

Vitalie Taulean said that according to the website of the Appeals Court, the hearing was to take place on January 26. The case was yet examined on January 24, in the absence of his client and in the presence of an ex officio lawyer who didn’t familiarize himself with the appeal and was unable to discuss with the person who he apparently represented.

In the hearing, the court decided that Vladislav Cucer will return to jail to serve the remaining time of 1 year and 11 months. The decision was taken even if the person showed determined wish for reeducation, responsibility and correctitude and didn’t commit deviations, stated Vitalie Taulean.

The lawyer sensitized to the deficiencies of the Penal Procedure Code that, as a result of particular amendments, does not allow the person to appeal the judgment. Before 2012, all these applications were examined by the Supreme Court of Justice and the convicts won some 50% of the examined cases.

Vitalie Taulean said he will file complaints to the Prosecutor General’s Office and the Superior Council of Magistracy so that the prosecutors and judges who took the decision to send his client back to jail are held accountable.

Vladislav Cucer told the same news conference that immediately after he was set free, he found a job and enrolled on cooking courses and all the money he earned he brought to the family as he has a four-year-old daughter to raise. He continues to work as a volunteer for the public organization that he joined when he was in detention and called on the President of Moldova Igor Dodon to take attitude to the illegal actions of judges. The convict’s wife Ala Valac said he is desperate. After she has educated alone their daughter for four years, she now has to explain to the child why her father, with whom she has a very powerful affective connection, has to return to jail.
