Law on construction authorizations presented in Chisinau
The Law on construction authorizations was presented in Chisinau on November 3 to the actors of the sector after its adoption 2 months ago, Info-Prim Neo reports.
The development and adoption of this law is an important step in de-bureaucratizating the construction authorization process. This program is promoted by the government with the assistance of the USAID/BIZTAR project.
Victor Ermurache, USAID/BIZTAR expert, said the law offers a high level of transparency, simplifying the procedure for obtaining the necessary documents, and canceling a series of previously required taxes.
Ion Pascal, deputy-minister of constructions and regional development, has mentioned that it’s the first time when the conditions for authorizing construction works are set by the law and not by a governmental decision. The law simplifies and explains the requirements for obtaining the urbanism certificate and construction/demolition authorization. Previously these requirements weren’t clear enough, which allowed for loose interpretations, thus some excesses, Ion Pascal has stressed.
The law compels the issuing public authorities to use the unique office principle when releasing the necessary documents for construction, uninvolving the solicitor. He will only have to submit his request, together with the papers to the local public authority. Afterwards he’ll only have to come and pick up the document.
Besides the aforementioned, the law sets exact deadlines: 20 work days for issuing the urbanism certificate (some exceptions require 30 days) and 10 days for the construction authorization. It must be registered at the National Construction Inspectorate, not having to submit any additional papers, within 3 days which are included in the 10 day deadline for obtaining the authorization. If the term is surpassed, and the solicitor hasn’t been informed in written form about that, he can start his construction, but has to inform the issuing authority and the National Construction Inspectorate about it.
The Law’s authors highlight the fact that it stipulates token payment for the documents’ issuing. These are set by local councils, but they cannot exceed 50lei for the urbanism certificate and 100 lei for the construction/demolition authorization. Previously these taxes were between 500 and 20.000lei and the documents were issued in more than a month’s period.
The law was approved by the Parliament on July 9 and took effect on September 3.
The Minister of Constructions and Regional Development and USAID/BIZTAR are currently working on a law regarding the accomplishment of the construction works.
