Judicial system is in a deadlock

The judicial system is in a deadlock that is caused also by the expiry of the five-year term in office of judges. The judges cannot be named until they do not reach the required age. A solution is to make legislative amendments, IPN reports.

In public herrings staged by the Parliamen’ts commission on appointments and immunities, the participants noted that the problems faced now by the judiciary derive from the incapacity to hold the General Assembly of Judges that hasn’t been convened for over two years.

Vladislav Clima, president of the Chisinau City Appeals Court, said the court now has 12 vacancies. Contests to fill these cannot be held as the Judge Performance Assessment Board and the Board for the Selection and Career of Judges are nonfunctional. Twenty-nine candidates are waiting for the contest at the Appeals Court.

Vladimir Timofti, acting president of the Supreme Court of Justice, said the main problem resides in the deadlock in activity and the impossibility of adopting explicative decisions and consultative documents.

The participants ascertained that the filling of the vacancies is one of the steps needed to break the deadlock, but the legal framework needs to be amended. The commissions’ head Vasile Bolea urged to formulate common proposals and to draft a bill to this effect.
