Judges responsible for cases lost at ECHR could face dismissal

The judges whose decisions led to the Government being fined by the European Court of Human Rights (ECHR) on applications lodged by Moldovan citizens could face dismissal if a proposal to this effect by Democrat MP Iurie Bolboceanu is adopted in Parliament. Iurie Bolboceanu told Info-Prim Neo that the measure targets in particular the judges who are responsible for two or more cases being lost at the ECHR. “We believe that this proposal can make judges more responsible. The Government of Moldova was sanctioned by the ECHR multiple times, and that entailed considerable damages”, said the MP. Iurie Bolboceanu says some research he has made indicates that there is a host of judges whose decisions led to ECHR sanctions. The Democrat also intends to submit a proposal that would allow for the mediation of parties before the case is sent to court, which he thinks will help to solve the high caseload problem faced by the courts. As of 31 December 2011, the ECHR found the State of Moldova responsible for violations in 227 cases, ordering it to pay over 12.8 million euros in total.
