Judge Victor Puscas banned from taking part in deliberations on Communist MPs' challenge

The Constitutional Court judge Victor Puscas was not allowed to participate in the deliberations on the challenge submitted by Communist MPs Maria Postoiko and Vadim Misin. The decision was made at the request of the Communists Party's representative Sergiu Sarbu. The MPs asked the Court to rule whether the Parliament violated the Constitution when it modified the law on the election of the head of state, Info-Prim Neo reports. In his application, Sergiu Sarbu said that judge Victor Puscas expressed publicly his position on the Communists Party's challenge before the court passed judgment. In an interview for Radio Free Europe on March 9, Puscas said the Parliament can be dissolved one year after the last dissolution (as the amendments introduced by the government coalition provide – e.n.). "Such behavior is not in accordance with the status of judge,” Sergiu Sarbu said. In a brief answering a Moldovan Constitutional Court's inquiry concerning the interpretation of two constitutional articles made public on March 15, the Venice Commission says that the President of the Republic (of Moldova) should dissolve the legislative body not earlier than a year from the last dissolution of Parliament. The answer of the Venice Commission refers to the question of how the phrase “in the course of the year” should be interpreted with respect to the dissolution of Parliament – meaning one calendar year, until December 31, or 365 days from the last dissolution.
