Judge Dorin Popovich of the Buiucani District Court was discharged from post. On March 23, the Supreme Council of Magistrates quashed the March 5 decision of the Disciplinary Board to give a severe reprimand to the judge, ruling that he should be dismissed, Info-Prim Neo reports.
The Disciplinary Board's decision of March 5 was challenged by Minister of Justice Alexandru Tanase as well as Dorin Popovich.
Dorin Popovich said that in April 2009 he tried cases inside police commissariats on the instructions of the former president of the Supreme Council of Magistrates Nicolae Clima and former president of the Supreme Court of Justice Ion Muruianu.
The Minister of Justice accused Popovich of ordering arresting persons after examining the cases for only 6-7 minutes and of ruling that Oxana Radu be arrested without asking her about the age of her child, who was minor and remained home alone.
Before going for deliberations, Minister Alexandru Tanase said the severe reprimand does not match the gravity of the decisions passed by Dorin Popovich in police commissariats, where cases cannot be judged. According to him, a severe reprimand will only encourage other judges to commit offenses.
Dorin Popovich made no statement after the Supreme Council of Magistrates passed judgment in his case. The decision can be appealed to the Chisinau Court of Appeals.
The hearing was attended by representatives of the civil society who repeatedly notified the Supreme Council of Magistrates of the violations committed by the judge. A part of them came with placards, demanding that Dorin Popovich be dismissed. Jurist Ion Guzun, of the Moldova Institute for Human Rights, said more judges committed irregularities during the April events, but they cannot be held accountable because the victims filed no complaints.
