Judge Babenco shares no blame for Bagirov's abscondment

The Superior Council of Magistrates (SCM) found that Borislav Babenco, the investigative judge who relaxed the preventive arrest measure imposed on Russian blogger Eduard Bagirov to a house arrest, acted in perfect compliance with the law, Info-Prim Neo reports. At its plenary meeting today, the SCM heard a report on the judge's actions. Rapporteur Dina Rotarciuc stated the blame lies with those who were charged with Bagirov's surveillance during his house arrest, rather than with Judge Babenco. The rapporteur named the Prosecutor General's Office (PGO), the Security and Intelligence Service (SIS) and the Ministry of Interiors among the agencies responsible for such surveillance. Judge Babenco himself said the decision to place Bagirov under house arrest was the only legal solution, and a failure to do so would have earned Moldova yet another case at the European Court of Human Rights. Russian blogger and author Eduard Bagirov, suspected by the Moldovan authorities of involvement in orchestrating the April 2009 violent events, absconded from investigation and fled to Russia after being placed under house arrest in October 2011. Earlier a parliamentary inquiry found Judge Babenco, the SIS and the PGO responsible for his abscondment.
