Invitro Diagnostics rejects Tudor Ceaicovschi’s accusations

Invitro Diagnostics rejects the accusations formulated by Tudor Ceaicovschi and his lawyer in a press conference on Thursday, calling them “false”. At the same time, the lawyer of the Invitro Diagnostics company, Tudor Buzdugan, told IPN that the company does not undergo insolvency, as according to the court’s decision, the company is in the observation period.

In a statement, Invitro Diagnostics recalled that the company was incorporated on May 21, 2014. In 2016, Tudor Ceaicovschi was invited by other partners as an associate. He claimed to have extensive expertise in medicine and promised to deliver medical equipment with a markup not exceeding 5%. On June 22, 2016, the founders of Invitro Diagnostics SRL became Alexandru Ceaicovschi (son of Tudor Ceaicovschi.), holder of the 33.33% share, and two other persons with equal shares of 33.33%. The appointed administrators were Marin Bălănuță and Tudor Ceaicovschi. On May 18, 2018, an associate sold their share, with Alexandru Ceaicovschi and the other associate coming to hold 50% each. As a result, the associates to invest, and the assets increased from 8.9 million lei in the first year to 87.5 million lei in 2022.

Regarding the accusations of tax fraud, the Invitro Diagnostics administration categorically rejects them and declares that it is a transparent company, included in the list of large taxpayers (with taxes paid over 40 million lei annually) and believes that the state authorities monitor the activity the company, being open for any verification. Invitro Diagnostics strongly denies the claim that it has used unauthorized tests/reagents in laboratory investigations.

“After the pandemic period, the administration and associates of SRL Invitro Diagnostics discovered that Tudor Ceaicovschi, through his companies, supplied medical equipment and consumables to SRL Invitro Diagnostics at prices inflated by approximately 500%, and the agreement concluded with the associates was violated. For this reason, it was decided to diversify the list of suppliers, which displeased Mr. Tudor Ceaicovschi. Only after an internal investigation was it found that Tudor Ceaicovschi, through SRL GBG-MLD, during the pandemic, abusing the dominant position on the market and the control exercised over SRL Invitro Diagnostics, delivered to it tests for the SARS virus -CoV-2/SARSCoV at prices 5 times higher than at other organizations. In particular, while other organizations received the tests at a price of 39 lei apiece, SRL Invitro Diagnostics bought them at a price of 136 lei. The money unjustifiably collected from SRL Invitro Diagnostics went directly to the companies of the Ceaicovschi family”, the company’s statement says.

In connection with this, Invitro Diagnostics has sued GBG-MLD for “unjustified enrichment”. The case is being examined by the Chisinau/Centru Court. As a result, the court has frozen 17.7 million lei of GBG-MLD’s assets.

Invitro Diagnostics also states that on September 1, 2023, it received a prior notification regarding the filing of the insolvency procedure, with GBG-MLD claiming 18.6 million lei. GBG-MLD, led by Tudor Ceaicovschi, filed several preliminary requests in court for the initiation of the insolvency process against Invitro Diagnostics. On September 8, by the conclusion of the Chisinau/Centru Court, the preliminary complaint was admitted for examination, with the appointment of a provisional administrator and the establishment of the observation period, with the matter to be heard in court on October 18, 2023

“The admission for examination of the introductory application and the establishment of the observation period in relation to SRL Invitro Diagnostics does not mean that the business is bankrupt; the financial diagnosis shows that the company’s liquidity and solvency indicators are above the limit recommended by law”, says the company.

“The statements made by Tudor Ceaicovschi in the press conference of October 4, 2023 constitute his strategy against the legal proceedings initiated against him for the fraudulent acts committed against SRL Invitro Diagnostics. After learning about Tudor Ceaicovschi’s fraud, SRL Invitro Diagnostics no longer purchases medical equipment and consumables from him in that volume. Tudor Ceaicovschi unfairly accuses the representatives of SRL Invitro Diagnostics with the purpose of being readmitted to the list of suppliers, this being a form of blackmail”, the press statements said.
