Any notary in the country will be able to perform inheritance procedures. Parliament gave a final reading to a bill that eliminates the exclusive territorial competence of notaries in matters of succession opening, IPN reports.
The bill providing for the elimination of the exclusive territorial jurisdiction of notaries in matters of succession procedure was drafted by a group of MPs of the Party of Action and Solidarity. The authors note that, at present the citizens’ access to notary services of this kind is unduly limited.
Respectively, in order to open the succession procedure, the persons concerned will be able to submit an application to any notary in the country. This is possible thanks to the creation of the Electronic Register of Succession Files and Wills and to the fact that notaries have access to various electronic registers.
Also, at the joint request of a simple majority of heirs, the notary will be able to transmit the succession procedure to another notary. “This will encourage a competitive spirit and ensure an increase in service quality and cost reduction,” reads the informative note to the bill.
The document will enter into force after technical conditions are created and the necessary changes are made in the information system Electronic Register of Succession Files and Wills, but no later than six months from the date of publication in the Official Gazette.
