Inebriated drivers and drivers without license risk remaining without vehicles

The persons who will be caught driving under the influence of alcohol or without a driver’s license could be stripped of vehicles, as could be those who consciously allow persons banned from driving to drive their vehicles, IPN reports.

The General Police Inspectorate said that the Instruction on the application of Article 439/7 of the Contravention Code concerning the special confiscation of vehicles within a contravention case was approved on September 4. “Special confiscation is applied by the court of law at the request of the ascertaining agent. The ascertaining agent of the police only ascertains the deed and later asks the court to apply the safety measure – the special confiscation of the vehicle,” said the Inspectorate.

Under the Contravention Code, the special confiscation consists in the forced and free transfer of possessions under state ownership. If these possessions no longer exist, cannot be found or recovered, the equivalent value of these is levied. The special confiscation covers the possessions used or intended to be used to commit a contravention.

The 1,200 accidents that occurred on the national roads during the first eight months of this year resulted in 122 deaths and 1,497 persons hurt.
