Important laws were adopted in 2016, but it happened after a stagnation of two-three years, considers Nadejda Hriptievschi, programs director at the Legal Resources Center of Moldova. In an interview for Radio Free Europe, the expert said that work on the Law on the Prosecution Service serrated in 2013. In 2014 the bill was ready, but it wasn’t put to the vote. This wasn’t done in 2015 either. The integrity package was ready in 2015, but also wasn’t voted, IPN reports.

“We must be very correct and say that the same ministers and MPs who now passed these legal acts earlier were against them, some of them, not all. So, a bitter taste remained as these laws weren’t adopted when they were ready – in 2015, 2014, 2013,” stated Nadejda Hriptievschi.

The expert could not say why this process was delayed for so long. She presumed there could have been some misunderstandings, negotiations inside or maybe the wish to replace the Government and name new ministers. The banking frauds also make us wonder if they didn’t allow the frauds to be committed and then adopted these legal acts later as a method of negotiation.

Nadejda Hriptievschi considers the improvement of the method of promoting and naming judges is a very big challenge for the legal system in 2017. The Superior Council of Magistracy is to promote judges without integrity-related problems, professional judges. The way in which the law on the reorganization of courts of law will be implemented is also a challenge.

Among the challenges are also the clarification of powers as regards the fight against grand corruption and reassessment of efficiency, including at the level of procedures so that they become more accessible and predictable and the judicial practice is more predictable. The legal system became a system that is not sufficiently accessible and predictable and this is inacceptable in a state with the rule of law.
